Wheel bin left out on the footpath ( not a local bin has a red top )

As you can see in the picture , this wheel bin has been out on the footpath for the last 6 weeks, it has rubbish in it in Black bin bags , beginning to smell a bit, for some reason not been emptied by the bin persons , an only assume that it not a legitimate bin for this area as it has a red lid. ( or has been put out by a house that is being rented as 2 properties ( has an annex flat on the side ) 2 bins one set of council tax )
