Greenery overhanging footway

Reported via mobile in the Overhanging branch/tree category anonymously at 15:48, Monday 29 May 2023

Sent to Buckinghamshire Council less than a minute later. FixMyStreet ref: 4607455.

Walkway users have to go onto the road to avoid the overhanging greenery which given the volume and speed of traffic using Joiners Lane is dangerous. This morning I noted a mobility scooter user having to move onto the road with her back to the oncoming traffic in order to avoid it.

Updates

  • This has been passed to our maintenance team who will carry out an assessment of the tree and provide an update within 28 days.

  • It is an offence under Section 1 of the Wildlife and Countryside Act of 1981 to intentionally take, damage or destroy the nest of any wild bird while it is in use or being built, or to intentionally kill, injure or take chicks or adults, or intentionally take or destroy any eggs.

As a general rule we avoid hedge cutting during the main breeding season for nesting birds, which usually runs throughout March to August each year. We follow the law and where possible the guidance provided by The Royal Society for the Protection of Birds. However, there may be cases when we cannot avoid disturbing a nest if it is obstructing the public highway, for example a nest in a tree branch overhanging the carriageway, in these rare cases we would apply to Natural England for a licence to carry out the work under the grounds of health and safety.
