The manhole cover on the side of the road heading into Beaconsfield newtown is loose so every time a car drives over it it creates a loud noise that disturbs my daughter and I's sleep. I previously reported this in January and for some reason toy closed it, even though you did nothing about it

This has been passed to the local area technician to investigate, they will carry out an inspection within the next 10 working days and if required arrange to resolve the issue.

We have now inspected the location and currently there are no defects that meet our minimum intervention levels for repair. Therefore, no planned repair is necessary at this time.
Research conducted by the Transport Research Laboratory (TRL) has resulted in the publication of various Reports on this matter, which are publicly available via the TRL website. The Reports indicate that there is limited evidence that traffic-borne impact vibration alone has any significant long-term effects upon the structural condition of a building. The finding is that there are various other factors which may be attributable to the structural condition of a building; namely, settlement, thermal and climatic movements, temperature and humidity conditions and air-borne road traffic vibrations (as opposed to direct road traffic vibrations).
The assertion is that traffic passing over the purported damaged/irregular areas of the carriageway generate ground borne impact vibration and is detrimentally affecting the long-term structure of properties. The onus or burden is thus placed on the residents of said properties to evidentially substantiate the factual basis or merit of this contention and provide evidence of a direct link of the carriageway vibrations to the impact of this on your property. Legally, this is known as the burden-of-proof and defines the duty placed upon a party to prove a (disputed) fact. It is not for the Council to demonstrate the above nor to commission any inspections in relation to this.
